Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 409, 420, 379, 120(B)/34 of the Indian Penal Code. Allegation is that accused persons misappropriated huge amount of money.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.12.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. No wrongful gain has

Following is the statement in paragraph 2 of the supplementary affidavit to the present application. "2. That without accepting his guilt for the purposes of bail petitioner is ready to deposit rupees one lakh in the court below subject to final outcome of the trial."

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit Rs.1 lac in the court below, subject to the final disposal of the case. On doing so, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Industrial P.S. case No.206 of 2018.
