Petitioner, already in custody, seeks bail in connection with Manihari P.S. Case No.22 of 2017, registered under Sections 341, 323, 324, 326, 307 and 379/34 of the Indian Penal Code. Allegation in brief is that the petitioner assaulted the informant with knife in the night and informed the family member from mobile phone and the case is instituted next morning. Submission is that as per the prosecution case the informant was assaulted in the night while returning back to home and the petitioner informed family members of the informant in the night itself but the case was lodged in the morning without any reason and no motive is assigned for committing the offence. The petitioner has clean antecedent and he is in custody since

Having considered the said facts and circumstances, petitioner Md. Jalaluddin @ Jalaluddin is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S. Case No.22 of 2017.
