JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-01-2015 This is an application for anticipatory bail in connection with a case registered for the offences punishable under Sections 147, 148, 149, 302 and 120B of the Indian Penal Code. The police case was instituted under Section 156(3) of the Code of Criminal Procedure upon direction by the Court of learned Chief Judicial Magistrate, Lakhisarai issued in Complaint case No. 151C of 2009. The petitioners are the ladies. Learned counsel for the petitioners, referring to the contents of the complaint petition, has submitted that there is no specific allegation against these petitioners of any overt act. He submits that there is specific allegation against one Hira Ram who has been granted the privilege of anticipatory bail by an order
Patna High Court Cr.Misc. No.31597 of 2014 (2) dt.30-01-2015 dated 13.5.2010 passed in Cr. Misc. 43826 of 2009, a Web copy of which has been produced by the learned counsel for the petitioners in Court.
Keeping in view the submissions as aforesaid, let the petitioners above named in the event of their arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisari in connection with Lakhisarai P.S. Case No. 317 of 2009, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
