JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 406,420 and 468/34 of the Indian Penal Code.
It is alleged by the informant that the informant and others including the petitioner collected money from public for deposit in a non-banking company namely Pratigya Housing Financial Company Ltd. but subsequently the company disappeared. One Ajay Kumar Mandal was incharge of the management of the company in Bihar.
It is submitted by the learned counsel for the petitioner that as per own admission of the informant petitioner was also a
Patna High Court Cr.Misc. No.23970 of 2015 (2) dt.09-07-2015 2/2 collecting agent like informant and he was not holding any post in the management of the alleged company. More over, the investigation has already concluded. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Forbesganj P.S. Case No. 330 of 2014 pending in the court of learned JM, Araria.
This application is disposed of with the aforesaid observation/direction.
