JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 120B/34 of the Indian Penal Code.
It is alleged that the informant deposited rupees forty five thousand in the account of the petitioner against the demand of rupees one lac for providing employment to the son of the informant but neither the employment was provided nor the money was returned.
It is submitted by the learned counsel for the petitioner that the petitioner is ready to return the amount which has been deposited in his account.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.31640 of 2014 (3) dt.02-04-2015 2/2 petitioner be released on provisional anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Nautan P.S. Case No. 33 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The provisional bail of the petitioner shall be confirmed by the learned court below on production of receipt of return of amount to the informant by the petitioner.
