The petitioner prays for grant of bail in Town P.S. Case no. 791 of 2018 registered for the offence punishable under sections 414, 420/34 IPC and section 30(a) of Bihar Prohibition and Excise Amendment Act.

There is allegation against this petitioner that he along with other co-accused were operating a syndicate to run the trade of illegal liquor and at his instance the alleged seized liquor was being transported by the vehicle.

It is submitted on behalf of petitioner that nothing has been recovered from conscious possession of the petitioner as he was not arrested on the spot and neither he is owner nor driver of the vehicle and is in custody since 07.12.2021.

Patna High Court CR. MISC. No.16857 of 2022(2) dt.20-05-2022 2/2 Learned counsel for the State opposed the prayer for bail and submitted that petitioner has got criminal antecedent of similar nature.

Considering the aforesaid facts and circumstances as well as fact that petitioner has got criminal antecedent of similar nature of cases, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected. However, the learned court below, where the case is pending, is directed to release the petitioner on bail, after framing of the charge. (Prabhat Kumar Singh, J) s.hassan/- U T
