Patna High Court CR. MISC. No.20615 of 2024(2) dt.27-03-2024 2/3 presumed offender has been done away with. It is also submitted that in the house many people reside, and it cannot be alleged with certainty that it was the petitioner, who had kept the liquor in the house or the liquor kept in the house was within her knowledge. It is also submitted that she came to be implicated at the instance of Chaukidar. It is next submitted that in most of the cases, innocent persons are being implicated by the police either at the instance of Chaukidar or local people. It is thus submitted that if the Chaukidar was aware that the petitioner had concealed the liquor in the house, why he did not inform the police earlier and why the said fact was disclosed after the liquor is alleged to have been recovered, which cast an aspersion on the case of the prosecution, when admittedly petitioner is a person with clean antecedent.
