JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 302 read with 34 of the Indian Penal Code and section 27 of Arms Act. As per the prosecution case, the petitioner and coaccused persons armed with rifles are said to have caused Bullet injury on the non-vital part of the body of the deceased. The fatal bullet injury is said to have been caused by Pramod Kumar Sharma @ Sadhu Sharma on the head of the deceased.

Patna High Court CR. MISC. No.17105 of 2022(2) dt.21-07-2022 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 30.01.2022. Learned counsel for the petitioner has further submitted that the co-accused person has already been granted bail by a Coordinate Bench of this Court vide order dated 28.06.2017 passed in Cr. Misc. No.19997 of 2017. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IX, Jehanabad, in connection with S.Tr. No. 351 of 2021 / 298 of 2021 arising out of Karpi (Banshi) P.S. Case No. 184 of 2010.

The application stands allowed.
