Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Maniyari P.S. Case No. 125 of 2022 registered for the offence under Sections 392 of the Indian Penal Code.

The prosecution story in short is that on 22.04.2022 at about 10:15AM, while the informant was coming from Sonvarsha, four criminals on two motorcycle surrounded him in which two criminals was armed with weapon. They stopped the motorcycle of the informant pointing revolver towards him and

Patna High Court CR. MISC. No.20532 of 2023(2) dt.23-05-2023 2/3 snatched gold chain from his neck and they took out Rs. 2100/- from his pocket. After that accused persons started abusing and threatening to the informant and they fled away. Learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2022 and the petitioner is not named in the F.I.R. and no incriminating articles has been recovered from the possession.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur, West/concerned Court below in connection with Maniyari P.S. Case No. 125 of 2022. The petitioner will visit Sarai, Vaishali Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
