The petitioner is in custody since 20.04.2018 in connection with Fulwaria P.S. Case No. 165 of 2016 for the offence registered under Sections 420, 409 of the Indian Penal Code.
Learned counsel for the petitioner submits that the Panchayat Secretary has also been made an accused in this case and the allegation that the solar light system which was given under some schemes was not completed, is entirely based on no material and the entire allegation is vague and misleading. It is further submitted that during the course of investigation, the investing agency has submitted that some of the schemes were completed, but since the petitioner was the Mukhiya at the
Patna High Court Cr.Misc. No.36716 of 2018(2) dt.10-07-2018 2/2 relevant point of time, she has been taken into custody. It was only because of the laches of the Panchayat Secretary of the relevant period who had not produced the documents and account books at the time of inquiry that the present case was filed against the petitioner.
Considering the aforesaid facts and circumstances of the case that since investigation has been completed and chargesheet has already been submitted, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai, in connection with Fulwaria P.S. Case No. 165 of 2016.
