The petitioner apprehends his arrest in Barh P.S. Case No.425 of 2018 registered under Sections 341, 323, 354, 325, 504, 506/34 of the Indian Penal Code.

The informant alleged that petitioner used to tease his daughter while she was on her way to school. When the informant went to complain about the behaviour of Ram Bali Kumar @ Rambali Paswan(the petitioner), his father Fagu Paswan assaulted the informant.

The learned counsel for the petitioner submits that the occurrence is alleged to have taken place on 02.11.2018 but fardbeyan was recorded on 04.11.2018. Prior to institution of the present case, Pintu Paswan, brother of the petitioner lodged Barh P.S. Case No.423 of 2018 against Suresh Yadav, Pappu

Patna High Court CR. MISC. No.18820 of 2019(2) dt.28-03-2019 2/2 Yadav(the informant) and others on 03.11.2018. On 05.11.2018 also, Savita Devi wife of Pintu Paswan lodged case against Ramesh Yadav and others who are the family members of the informant of the present case and only to create defence, the informant filed this case that the petitioner was teasing his daughter while she was going to school.

Taking into consideration the fact that there appears that before institution of the present case by the informant, from the side of the petitioner two cases were lodged against the informant and his family members, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, District-Patna in connection with Barh P.S. Case No.425 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
