This application has been filed for grant of regular bail on behalf of the petitioner who is in custody in connection with Kesaria P. S. Case No. 308 of 2012 giving rise to Sessions Trial no. 349 of 2017 instituted for the offences under Sections 366A/34 of the Indian Penal Code.
As per allegation, informant is the grand-father of the victim girl, namely, Sushila Kumari, who has been abducted by the accused. It has been stated that petitioner has named all the three accused on the basis of suspicion only. It has further been submitted that the incident took place on 08.11.2012, FIR was lodged on 10.12.2012 and the Magistrate took cognizance on
Patna High Court Cr.Misc. No.38834 of 2017 (2) dt.19-08-2017 12.12.2017. It has also been stated that one of the accused in Sessions Trial No. 332 of 2015 has been acquitted from the charge. In the said Sessions Trial informant has deposed and has not stated anything against petitioner. Petitioner is in jail custody since 22.02.2017.
Considering the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, East Champaran, in connection with Sessions Trial no. 349 of 2017 arising out of Kesaria P. S. Case no. 308 of 2012. (S. Kumar, J) sudip/- U T
