The petitioner apprehends his arrest in Akbarpur P.S. Case No.412 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.
The learned counsel for the petitioner submits that small quantity of country made liquor is said to have been recovered from the house of the petitioner. The petitioner has got no criminal antecedent.
Taking into consideration the fact that 6 liters country made liquor is recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, the learned court below shall consider the prayer for regular bail of
Patna High Court CR. MISC. No.14453 of 2020(2) dt.02-09-2020 2/2 the petitioner on its own merit and taking into consideration the fact that small quantity of liquor was recovered from the house of the petitioner and dispose of the bail petition of the petitioner preferably on the same day.
