14-01-2015 Heard learned counsel for the petitioner and Sri Shyam Kumar Singh, learned Addl. Public Prosecutor. The sole petitioner, who apprehends his arrest in connection with Dumariyaghat P.S. Case no.31 of 2014 registered for the offence under Section 414/34 of the Indian Penal Code, Sections 11(A)(B)(C)(D) (I)(N)(K) of Prevention of Cruelty of Animal Act, 1960 and Sections 46,47,48,50, 51 of Transport of Animal Act ,1978 has prayed for grant of anticipatory bail. It has been pleaded that though the petitioner is a owner of the vehicle in question, there is nothing to suggest that the petitioner was involved in the present case. In view of nature of accusation as well as fact of the

Patna High Court Cr.Misc. No.30591 of 2014 (2) dt.14-01-2015 2/2 case, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail to the petitioner. Let the petitioner, Jabir be enlarged on bail in the event of his arrest or surrender within a period of four weeks from today on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Sri Girish Mishra, Judicial Magistrate, 1st Class, Sadar Motihari, East Champaran in connection with Dumariyaghat P.S. Case no.31 of 2014 subject to the condition as laid down in Section 438 (2) of the Code of Criminal Procedure.
