Petitioner seeks bail in connection with Deep Nagar P.S. Case No. 239/17, for the offence punishable under Section 414 of the Indian Penal Code.
The prosecution case as lodged by the police personnel is that on secret information, the shop of the petitioner was raided and from the premises large number of iron rods of different sizes was recovered which was alleged to be government property. Accordingly, seizure list was prepared.
It has been submitted by the learned counsel for the petitioner that his father is proprietor of M/s Akash Traders who deals with iron rods and is a valid registration holder of G.S.T. and
Patna High Court Cr.Misc. No.43052 of 2017 (2) dt.18-09-2017 2/2 all the materials are being bought and sold under receipts. It is submitted that he bears no criminal history and the vouchers are in support of sales and purchases which is for the Commercial Taxes Department to assess. It is further submitted that the petitioner used to assist his father and he is languishing in judicial custody since 06.08.2017.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and materials on record, let the petitioner named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No. 239/17, subject to the condition that one of the bailors would be a close relative of the petitioner. (Nilu Agrawal, J) Vinita/- U T
