JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case filed with accusation for the offences punishable under Sections 147, 323, 384, 394 and 504 of the Indian Penal Code.

The prosecution case is that the complainant and her brother were assaulted and `1,500/-, wrist watch and gold chain were snatched.

It is submitted by learned counsel for the petitioner that the petitioner was on litigating terms. The complaint, filed with accusation under Section 498A IPC, has been referred to the Mediation Centre vide Cr. Misc. No. 32828 of 2014. The petitioner filed Complaint Case No. 747 of 2014 on 26.06.2014, thereafter, the present complaint was filed on 27.06.2014.

No.24772 of 2015 (2) dt.08-07-2015 2/2 Considering the relationship between the petitioner and the complainant and accusation levelled in the background of series of litigations going on between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Complaint Case No. 1654 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
