JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sono (Charkapathar) P.S. case no. 63 of 2018 for the offence under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that in the instant case from perusal of the fardbeyan itself it is evident that there is no specific overt act alleged against this petitioner. Referring to the injury report, he submits that one of the injury on the person of Kuldeep Yadav was found to be grievous in nature and rest others are simple in nature. The petitioner is in custody since 26.04.2018.

Learned counsel for the informant opposes the prayer

Patna High Court Cr.Misc. No.35055 of 2018 (5) dt.20-07-2018 2/2 for bail of the petitioner.

Considering the fact that there is no specific overt act has been alleged against the petitioner and also the fact that the petitioner is in custody since 26.04.2018, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of Additional Chief Judicial Magistrate, Jamui in connection with Sono (Charkapathar) P.S. case no. 63 of 2018.
