====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 18-05-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The case was listed in the Lawazima Board and the Lawazima Board, vide order dated 22nd November 2012, granted time to remove the defect but the petitioner did not comply the order. Again, the case was listed before the Bench on 26th April 2013 and one week further time was granted to remove the defect even then the petitioner had not complied the order which led to dismissal of Civil Review No. 335 of 2012.

The counsel for the petitioner submits that due to inadvertence and mistake the order dated 26th April 2013 has not been complied with.

Looking to the facts and circumstance, the present restoration application is allowed and Civil Review No. 335 of

Patna High Court MJC No.968 of 2015 (2) dt.18-05-2015 2/2 2012 is restored to its original file.

The petitioner is directed to comply the order of Lawazima Board dated 22nd November 2012 by one week after ensuing annual vacation, peremptory.
