The petitioner apprehends his arrest in Motihari Town P.S. case No. 388 of 2018 registered under Section 366A, 372, 34 of the IPC.
The mother of the informant alleged that Satish Kumar, brother-in-law of her tenant, Anuj Kumar, with the help of other accused persons, kidnapped her minor daughter for illegal purpose.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of the petitioner figured in the case in the statement of victim recorded under Section 164 of the Cr. P. C. From perusal of the FIR it appears that victim became traceless after 10 PM in the night. The
Patna High Court CR. MISC. No.15538 of 2019(2) dt.14-03-2019 2/2 victim alleged that petitioner forcibly got her married with Satish Kumar. The victim did not make any allegation of kidnapping against the petitioner.
Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P.S. case No. 388 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
