A supplementary affidavit is being filed by the learned counsel for the petitioner in the Court today. The same is accepted and kept on record.
The petitioner apprehends her arrest in a case in connection with Maner P.S. Case No.198 of 2019, corresponding to G.R. No.1380 of 2019, registered for the offence punishable under Sections 304B/201/34 IPC.
The prosecution case in short is that the sister of the informant has been killed by all the in-laws people including the petitioner due to non-fulfillment of demand of dowry. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is the sister-in-law of the deceased and lives in her matrimonial house. She has been falsely implicated in this case.
Patna High Court CR. MISC. No.20487 of 2020(6) dt.08-12-2021 2/2 The allegation leveled against the petitioner is not specific rather general and omnibus in nature. The husband of the deceased namely Gopal Yadav has already been enlarged on bail by a coordinate Bench of this court vide order dated 05.10.2020 passed in Cr. Misc. No.20597 of 2020. It is further submitted that several other similarly situated co-accused have also been granted the privilege of anticipatory bail by different co-ordinate Benches of this Court and petitioner has no criminal antecedent. Learned APP for the State opposed the prayer for bail.
Having regard to the facts and circumstances of the case, since husband of the deceased has been enlarged on bail, let the above named petitioner, be also released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Maner P.S. Case No.198 of 2019, corresponding to G.R. No.1380 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
