JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This application, for grant of anticipatory bail, arises out of Raniganj P.S. Case No. 351/18, disclosing offences under Sections 147, 341, 148, 323, 379, 354(B), 427, 506 and 504 of the Indian Penal Code.

Prosecution case is that the petitioners along with others armed with deadly weapons came and assaulted the informant and damaged the thatched and co-accused Nathu Singh snatched away golden chain worth Rs. 46000/- and petitioner no. 2 tore her sari and blouse.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.19065 of 2019(2) dt.07-05-2019 2/2 that a case has also been lodged by the petitioners side and further there is no allegation of assault by any weapon rather the allegation that they assaulted her by means of fists and slaps and no specific allegation has been levelled and so far allegation that petitioner no. 2 tore her sari and blouse is concerned, the same is ornamental.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Raniganj P.S. Case No. 351/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
