JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner, who is in custody since 11.01.2020, seeks bail in connection with Khiri More P.S. Case No. 101 of 2019, dated 06.12.2019, instituted for the offence under Sections 406, 420 and 409 of the Indian Penal Code.

It is alleged that petitioner in his capacity as Director of Customer Service Point of village Mahuari has embezzled three thousand from the account of two of the beneficiaries of a Social Welfare Scheme. Learned counsel for the petitioner has submitted that there is no definite proof of such embezzlement by the petitioner and he has been made accused in this case at the instance of his brother with whom he has property dispute.

Patna High Court CR. MISC. No.14248 of 2020(2) dt.04-03-2020 2/2 Regard being had to the period of custody the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class Danapur in connection with Khiri More P.S. Case No. 101 of 2019.

The application stands allowed.
