ANJANA MISHRA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Gamharia P.S. Case No.50 of 2012 registered for the offences under Sections 406, 409, 419, 420, 465, 466, 467, 468, 471, 474, 34 of the I.P.C.
It is submitted on behalf of the petitioner that in the F.I.R. his name does not surface but subsequently, the petitioner's name has been brought in only because he identified the withdrawal form. The petitioner in his professional capacity has identified the deponent only for the purpose of getting duplicate Bank Pass- Book. Learned counsel for the petitioner further submitted that though it has been stated that the said Nunudai Devi
Patna High Court Cr.Misc. No.30999 of 2014 (2) dt.20-01-2015 2/2 died on 10.6.2011 the anganbari sewika has issued certificate of death of Nunudai Devi as not being dated10.6.2011. Rather according to death register of Anganbari Sewika it is 29.9.2011. Considering the aforementioned submission and also the fact that other similarly situated person, namely, Shashi Shekhar Bharti has already been granted anticipatory bail by the learned court below, let the petitioner, above named, in the event of his arrest or surrender before the court below within two weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Madhepura, in Gamharia P.S. Case No.50 of 2012 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
