JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-08-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Saraiya (Jaintpur O.P) P.S. Case no. 11 of 2020, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that in course of patrolling duty, the informant and other Police personnel received information to the effect that Ravish Kumar (Petitioner) of village-Nawada is indulged in removing liquor from his house, thereafter, informant and other Police personnel reached in villageNawada at the door of Ravish Kumar (Petitioner) then found an Alto car bearing registration No. WB-24C-4469 parking there. On seeing the Police party, petitioner and one Brajesh Kumar

On search of the said Alto car, 30 bottles, each containing 750 ML and 48 bottles, each containing 375 ML Indian made foreign liquor recovered.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the alleged bottles of Indian made foreign liquor are said to be recovered from the abandoned car, which was parked nearby the house of petitioner. Further submission is that petitioner is not the owner of the said vehicle. Further submission is that, in fact, due to dirty village politics, the petitioner and one Brajesh Kumar have falsely been implicated in this case by the local Chowkidar. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge Excise, Muzaffarpur in connection with Saraiya (Jaintpur O.P) P.S. Case No. 11 of 2020, subject to the condition as laid down under
