JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 316, 504 and 379/34 of the Indian Penal Code.

Allegation against the petitioner is that he gave heel blow on the abdomen of the informant's wife as a result of which her pregnancy was aborted.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. Petitioner has falsely been implicated in the present case. The injury report does not support the allegation made in the F.I.R.

On behalf of the State, it is submitted that petitioner is named in the F.I.R. and there is specific allegation against this petitioner. The other co-accused has been granted regular bail. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.

Any how, if petitioner surrenders in the court below, i.e., learned Judicial Magistrate, Ist Class, Motihari, East Champaran, in connection with Chakia P. S. Case no. 81 of 2014 within a period of six weeks from the date of receipt of a copy of this order

Patna High Court Cr.Misc. No.21831 of 2016 (2) dt.27-06-2016 2/2 and prays for regular bail, same shall be considered and disposed of on its own merit taking into account that other co-accused have been granted bail without being prejudiced by this order. (Sudhir Singh, J) sudip/- U T
