JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.2956 of 2017, Trial No. 1939 of 2018 disclosing offences under Sections 406, 34 of IPC.

Allegation against the petitioner as per complaint petition is that he has taken Rs.70,000/- for providing job in foreign country and thereafter, provided a visa, on which, complainant went to foreign country and on inquiry, he found that his visa was with respect to tourist visa and there is no company as stated by the petitioner.

Submission of the learned counsel for the petitioner is that earlier he has filed a complaint against the complainant, for that the present case has been lodged.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
