JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special (Excise) Case No. 4207 of 2018, arising out of Beur P.S. Case No. 130 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner is in custody since 04.05.2018 and as such he has completed approximately two months. He submits that from the prosecution case itself, it would be evident that the petitioner was apprehended in the instant case only on account of suspicion. Considering the fact that petitioner has no criminal antecedent and he has remained in custody for approximately two months, the petitioner, named above, is directed to be released on
