====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-03-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Section 135 of the Electricity Act, registered in connection with Wazirganj P.S. Case No. 133 of 2020. The allegation against the petitioners is that they have pilfered the electricity by hooking the connection wire and due to this act of the petitioners, a huge loss of Rs. 2,31,259/- and 2,20,689/- respectively has been caused to the Electricity Department.

Learned counsel for the petitioners has submitted that petitioners are ready to deposit 25% of the amount at the time of

Patna High Court CR. MISC. No.26625 of 2021(2) dt.07-03-2022 2/2 submission of bail bond and rest 25% of the amount within two months.

Considering the aforesaid submission, the abovenamed petitioners, in the event of their arrest or surrender before court below within four weeks from the date of communication of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity), Magadh Area, Gaya in connection with Wazirganj P.S.Case No. 133 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition that petitioners shall deposit 25% of the aforesaid amount at the time of furnishing bail bond and rest 25% of the amount within two months. The deposit of the amount shall be subject to final outcome of the case. Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
