The present case was registered under sections 147, 148, 448, 323, 504, 479, 376/511 of the Indian Penal Code and section 3(10) of the SC and ST (Prevention of Atrocities) Act but according to the prosecution case itself, the alleged occurrence took place as the petitioners wanted to flow water forcibly from the land of the informant. Further more, the impugned order reveals that in course of investigation the witnesses did not support the allegation of outraging the modesty of the informant's daughter-in-law.

Considering the aforesaid facts and

Patna High Court Cr.Misc. No.12588 of 2015 (2) dt.18-05-2015 2/2 circumstances of the case as well as submissions of the parties, let the above named petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of A.C.J.M, Jamui in S.C. & S.T.
