JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 19-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 363, 365/ 34 of the Indian Penal Code and sections 8 and 12 of the POCSO Act. As per prosecution case, the petitioner and co-accused persons are said to have kidnapped the two victim girls aged about 16 years and 17 years.

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner has no criminal antecedent as stated at para 3

Learned counsel for the petitioner has further submitted that the chargesheet has already been submitted and kidnapped girls have already been recovered. Learned counsel further submits that the co-accused person has already been granted bail by a Coordinate Bench of this Court vide order dated 14.06.2022 passed in Cr. Misc. No. 13331 of 2022. The petitioner is in custody since 17.11.2021 and the petitioner is a lady. There is no allegation of physical or sexual assault against the petitioner. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances as well as period of detention, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIIth-cumSpecial Judge (POCSO), West Champaran, in connection with Sathi P.S. Case No. 210 of 2021.

The application stands allowed.
