2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Phulwaria P.S. Case No. 194 of 2025 instituted for the offence under Sections 191(3), 190, 115(2), 126(2), 109, 303(2), 324(4), 324(5), 308(3), 308(4), 351(2), 351(3) of the B.N.S., 2023 and Section 27 of the Arms Act.

3. The case of the prosecution, in short, is that the petitioner, along with others, arrived and it is alleged that the petitioner demanded extortion money of ten lakh rupees. It is further alleged that one Dhanraj Kumar made fire, but the gunshot injury did not hit anybody.

4. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.17304 of 2026(2) dt.18-03-2026 2/3 has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He also submits that the only allegation against the petitioner is that of demanding extortion money of ten lakh rupees. No cash has been paid. He further submits that Dhanraj Kumar who was having allegation of firing has been granted anticipatory bail by the learned coordinate bench of this court vide Cr. Misc. No. 5182 of 2026. The case of this petitioner stands on better footing. He further submits that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

5. In contra, learned APP appearing for the State and learned counsel for the informant have opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Phulwaria P.S. Case No. 194 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
