The petitioner apprehends his arrest in Mokama P.S. Case No. 71 of 2015 registered for the offences punishable under Sections 420, 406, 467, 468 and 120B of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that Raghunath Mahto and Kashinath Mahto persuaded him to deposit money in Common Well Bakerej Company Limited. Name of the petitioner appear at serial number 6 in the accused column and it is alleged that the petitioner is also name holder in the company. It is alleged that Rs. 80 lakhs have been misappropriated by the officers of the company. It is submitted that the informant did not make any sorts of allegation against the petitioner. The petitioner is also employed

Patna High Court Cr.Misc. No.22077 of 2016 (5) dt.19-10-2016 2/2 as computer trainer in the company. The petitioner did not receive any money from the informant or from any other customer. Considering the facts aforesaid and the fact that the informant did not make any sorts of allegation against the petitioner about receiving any money and the petitioner is also an employee of the company, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna in Mokama P.S. Case No. 71 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
