The petitioner seeks bail in connection with Rupaspur P.S. Case No. 173 of 2018 registered Sections 30(a), 37(b) (c) of Bihar Prohibition and Excise Act-2016. 16 lts. of country made liquor is said to have been recovered from possession of the petitioner and she was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. She has no concern with the seized liquor. She has been falsely implicated in this case at the instance of her enemy by planting the
Patna High Court Cr.Misc. No.35248 of 2018(2) dt.28-06-2018 2/2 aforesaid recovery from her possession. She has no criminal antecedent. She happens to be lady. She has been languishing in custody since 2.05.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Rupaspur P.S. Case No. 173 of 2018.
