2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Sahiyara P.S. Case No. 170 of 2025 instituted for the offence under Sections 103(1), 3(5) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that the petitioner along with others were having scuffle with one Raushan Kumar. It is further alleged that the father of the informant, namely, Khobhari Sahani went there to settle the dispute. On this he was assaulted by all the accused persons with lathi danda due to which he died.

4. Learned counsel appearing on behalf of the petitioners have submitted that petitioners are innocent and have committed

Patna High Court CR. MISC. No.17763 of 2026(2) dt.18-03-2026 2/2 no offence. The nature of allegation against the petitioners are general and omnibus. He also submits that there is no specific allegation against the petitioners that they have assaulted the deceased. He further submits that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Similarly situated other co-accused person has already been granted bail by this Court vide Cr. Misc. No. 16305 of 2026.

5. In contra, learned APP appearing for the State has opposed the prayer of anticipatory bail of the petitioners.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Sahiyara P.S. Case No. 170 of 2025, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
