JUSTICE ARUN KUMAR ORAL ORDER 20-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Jokihat (Mahalgaon) P.S.Case No. 376 of 2017 registered under Sections 395, 397 and 412 of the Indian penal Code.

Submission is that FIR is against unknown and neither any looted article has been recovered from the possession of the petitioner nor was put on TIP nor leading to his confessional statement, anything has been recovered from his possession or from other co-accused and similarly situated co-accused persons have been admitted to bail by Co-ordinate Benches of this Court vide Cr. Misc. No. 11749 of 2018, Cr. Misc. No. 24611 of 2018, Cr. Misc. No. 24630 of 2018 and Cr. Misc. No. 34666 of 2018. Having considered the aforesaid facts and circumstances, as the case of the petitioner stands on similar footing, so

Patna High Court Cr.Misc. No.35175 of 2018(2) dt.20-06-2018 2/2 petitioner, namely , Md. Ekhlaque, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 376 of 2017.
