The petitioner apprehends his arrest in Ghosi P.S. Case No. 310/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that while he was coming to his home Akhilesh Singh and Arun Kumar fired which hit on the thigh of the informant and the accused persons also took away money, mobile etc.
Learned counsel for the petitioner submits that the petitioner is driver of auto rickshaw. Some altercation took place for carry gas cylinder. The witnesses have stated that the informant began to abuse the petitioner on such, the petitioner and
Patna High Court Cr.Misc. No.20247 of 2016 (3) dt.26-07-2016 2/2 others assaulted him with iron rod. The petitioner assaulted the informant with iron rod.
Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrender in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail learned court below shall consider his case on its own merit and dispose of the bail petition preferably on the same day.
