JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhagwan Bazar P.S. Case No. 351 of 2018 registered for the offences punishable under Sections 413 and 414/34 of the Indian Penal Code.

Allegation as per FIR is that police on confidential information raided the house of the accused persons and recovered three motorcycles.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and he has falsely been implicated in this case and other two co-accused, i.e. his father and brother have been granted bail by the court below itself. Heard learned APP also.

In view of above facts and circumstances, I am not

Patna High Court CR. MISC. No.17251 of 2019(5) dt.30-07-2019 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered in view of the fact that co-accused persons have been granted bail by the court below itself. With the above observation, this application is dismissed.
