BAJANTHRI) Date : 15-05-2024 The present MJC is presented for non-compliance of the order dated 15.05.2014 passed in LPA No. 54 of 2012. There is enormous delay of about nine years in filing MJC. Section 20 of the Contempt of Courts Act, 1971 provides for filing contempt petition within one year from the date of cause of action occur to a party. Co-ordinate Bench of this Court in the case of Dr. Rajesh Kumar Sinha & Ors. Vs. The Union of India & Ors

Patna High Court MJC No.762 of 2024 dt.15-05-2024 2/2 bearing M.J.C. No. 1840 of 2023 in C.W.J.C. No. 13888 of 2016, elaborately considered Section 20 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution. Accordingly, the present contempt petition is not maintainable in the light of Co-ordinate Bench decision. Petition stands dismissed reserving liberty to the petitioner to file CWJC afresh, in accordance with law.
