NILU AGRAWAL ORAL ORDER 23-08-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner was granted privilege of bail in Cr. Misc. No. 30738 of 2017 on 09.08.2017. He has filed a modification petition stating therein that the condition imposed while granting bail that "one of the bailors would be a close relative of the petitioner having sufficient immovable property within the jurisdiction of the concerned police station" cannot be complied as the petitioner belongs to village Sakra, P.S. G.B. Nagar, District Siwan and the matter is with regard to Pachrukhi P.S. and he seeks modification of the said condition on that ground. Learned counsel for the informant has filed his counter affidavit stating therein that he is apprehending that the petitioner will abscond after being granted bail, hence, close relative may be

Patna High Court Cr.Misc. No.40168 of 2017 (2) dt.23-08-2017 2/2 substituted by villager of the Panchrukhi Police Station. Counsel for the petitioner has no objection, as such, the condition is modified to the extent that one of the bailors would be a villager within Panchrukhi Police Station.

The said order is modified to the extent indicated above in connection with S.T. No. 335/2016, arising out of Pachrukhi P.S. Case No. 301/2015, pending in the court of learned ADJ-II, Siwan.
