The petitioner is apprehending his arrest in a case registered under section 307 and other allied sections of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused persons assaulted the informant with lathi and danda with an intention to kill him and due to which the informant and his son received injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that there is a case and counter case and injury has been sustained in both sides. The prosecution has not explained the
Patna High Court Cr.Misc. No.24083 of 2015 (3) dt.03-09-2015 2/2 injury sustained on the accused persons which casts serious doubt upon the prosecution.
On behalf of the State and the counsel for the informant it is submitted that the petitioner is named in the first information report.
Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Raja Pakar P.S. Case No. 144 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
