Petitioner seeks bail in Jagdishpur P.S. Case No.546 of 2018 instituted for the offence under Section(s) 452 Indian Penal Code, Sections 25(1-b)a, 26 of the Arms Act and Section 37-C of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that one country made pistol and one cartridge have been recovered from possession of the petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 06.12.2018 having clean antecedents. Seizure list is part of the First Information Report, which does not bear signature of the petitioner.

In the facts and circumstances of the case, prayer of

Patna High Court CR. MISC. No.15534 of 2019(2) dt.13-03-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ 2nd cum Special Judge, Excise, Bhagalpur, in connection with Jagdishpur P.S. Case No.546 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
