Heard the parties.

Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the IPC and Section 30(a),41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioner was not there at the time of recovery of liquor. Petitioner is in jail since 16.10.2020. Name of the petitioner surfaced on the report of the local Chaukidar regarding involvement of the petitioner and co-accused. The coaccused has already been allowed bail by a Coordinate Bench of this Court.

Submission is that due to criminal record in the police station relating to other offences and not under Bihar Prohibition and Excise Act, the petitioner is victim of police atrocity without any substantial material for the same.

No.27467 of 2021(2) dt.04-10-2021 2/2 Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Siwan (Muffasil) P.S.Case No.522 of 2018 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
