Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Buxar (T) P.S. Case No. 704 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner along with other FIR named accused persons and two unknown persons committed murder of the son of informant.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to civil

Patna High Court CR. MISC. No.27222 of 2021(3) dt.27-09-2021 2/2 dispute between the parties. Postmortem report does not support the prosecution case and no incriminating article has been recovered from possession of this petitioner. Petitioner is in custody since 22.10.2019. Investigation is complete. Counsel for the informant however, vehemently opposed the prayer for bail and submitted that this petitioner and two FIR named accused persons and others committed murder of the son of informant.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
