The petitioner in Cr. Misc. No. 34170/2014 and the petitioner in Cr. Misc. No. 34394/2014 apprehend their arrest in Basnahi P.S. Case No. 24 of 2014 registered under Sections 366(A)/34 of the Indian Penal Code.

Anil Yadav, the informant, named Shaligram Mandal and one unknown person and alleged that while his miner

Patna High Court Cr.Misc. No.34170 of 2014 (2) dt.10-02-2015 2/2 daughter went to attend the call of nature along with her mother Asha Devi, Shaligram Mandal forcibly kidnapped his daughter. The informant alleged that he went to the house of Shaligram Mandal where his parents also assured him to help in searching out his daughter.

Learned counsel for the petitioners submits that immediately after the occurrence, the informant went to the house of the petitioners and informed about the kidnapping of his daughter by Shaligram Mandal. There is no allegation of kidnapping against the petitioners.

Considering the facts aforesaid and the fact that there is no allegation of kidnapping against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K. Manjhi, Judicial Magistrate, Saharsa in Basnahi P.S. Case No. 24/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
