JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Rajivnagar P.S. Case No. 240 of 2014 registered under Sections-323, 341, 379, 504/34 of the Indian Penal Code. It appears from perusal of the first information report that petitioner and other accused used to tease the informant's son and on the date of occurrence, they assaulted him and also snatched his money.
The contention on behalf of the petitioners is that except Section-379 of the Indian Penal Code, almost all the sections are bailable in nature and so far as Section-379
Patna High Court Cr.Misc. No.29386 of 2015 (2) dt.28-07-2015 2/2 of the Indian Penal Code is concerned; the same is not specific against the petitioners. It is further contended that moreover, parties have already entered into compromise. Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Rajivnagar P.S. Case No. 240 of 2014 to the satisfaction of Miss Sangeeta Rani, Judicial Magistrate-Ist Class, Patna subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
