The sole petitioner, who is in custody since 25-06-2017 in Birpur P.S. Case No. 165 of 2017 registered for offence under Sections 38(1)(2), 41(1)(2) of the Bihar Prohibition and Excise Act, 2016 and Sections 420/34 of the Indian Penal Code, has prayed for grant of bail. The petitioner is in custody on an accusation of recovery of huge quantity of Nepali liquor. It was alleged that petitioner was carrying huge quantity of Napali liquor on a motorcycle. While intercepting motorcycle of the petitioner, two other motorcycles were also intercepted, from which also, recovery was effected.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Santosh Mandal @ Santos Mandal be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II, Supaul in connection with Birpur P.S. Case No. 165 of 2017, vide S.T.- 621/2017.
