2. The petitioner seeks bail in connection with Rajoun P.S.Case No. 221 of 2021 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
3. The petitioner along with other accused persons assaulted the informant's son with lathi, danda and Katta indiscriminately causing head injury and during the course of treatment he died.
4. Learned counsel for the petitioner submits that petitioner is in custody since 11.01.2024. The petitioner has got clean antecedent. There is general and omnibus allegation and delay of 5 days in lodging of the FIR
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.18167 of 2024(2) dt.14-03-2024 2/2 bail.
6. Considering the aforesaid facts and circumstance of the case, let the above named, petitioner is directed to released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Banka in Rajoun P.S.Case No. 221 of 2021 , subject to the following condition:- The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner shall be cancelled.
