2. Learned counsel for the petitioner submits that the prayer for bail of the petitioner has earlier been rejected vide order dated 03.10.2024 passed in Criminal Miscellaneous No.71831 of 2024 and order dated 16.05.2025 passed in Criminal Miscellaneous No.11451 of 2025.
3. Learned counsel further submits that charge has already been framed in this case and the antecedent of the petitioner is clean. He further submits that allegedly recovery of 10.400 kg of ganja from the possession of the petitioner is the subject matter of this case. He further submits that the alleged recovered contraband is less than the commercial quantity but

4. Learned counsel for the State opposes the prayer for bail and submits that recovered contraband is less than the commercial quantity and charge has been framed.
5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of learned Exclusive Special Court No.1, NDPS Act, Muzaffarpur. in connection with N.D.P.S. Case No. 153/2024 (arising out of Rail Muzaffarpur P.S. Case No. 171 of 2024), subject to the conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bonds by the Trial Court itself;
(iii) the petitioner shall appear before the concerned

No.17401 of 2026(2) dt.18-03-2026 3/3 police station every month for one year to mark attendance; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of the bail bonds; and (v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of the bail bonds.
