Mr Anjani Kumar Mishra, Advocate ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 25-02-2019 Heard learned counsel for the petitioner and the respondent-Bank.
The petitioner claims that in light of the provisions contained in the Bank's Circular dated 26.09.2008, the amount outstanding under the heading Housing Loan should have been realized in installments. He is aggrieved by the settlement of his loan account by debiting an amount of Rs 2,36,242/- at the time of his retirement from the services of the Bank. The Circular dated 26.09.2008 relied upon by the petitioner is subject to fulfillment of various conditions. The writ petition does not disclose that the petitioner complies with
Patna High Court CWJC No.13511 of 2014(2) dt.25-02-2019 2/2 all the requirements under the Circular dated 26.09.2008. On account of insufficiency of pleadings, it is not possible for this Court to arrive at a conclusion that the petitioner has been able to make out a prima facie case for exercise of jurisdiction in his favour for the benefits flowing on account of Circular dated 26.09.2008.
Writ petition is devoid of merit and the same is dismissed.
