JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 The petitioner seeks bail in connection with Nawada Town P.S.Case No. 15 of 2018 registered under Sections 364/34, 302,201 and 120B of the Indian penal Code. Earlier prayer for bail of the petitioner was rejected twice vide order dated 01.08.2018 and 16.01.2019 passed in Cr. Misc. No. 32013 of 2018 and Cr. Misc. No. 78765 of 2018 respectively with liberty to renew his prayer for bail after framing of charge.
The allegation against the petitioner is that he along with others dragged the deceased outside the bus and taken him on a Bolero vehicle and later on, his dead body was recovered. Submission of learned counsel for the petitioner is that accused persons having similar allegation have been granted bail by co-ordinate Benche of this Court vide order dated
Patna High Court CR. MISC. No.15303 of 2019(2) dt.27-03-2019 2/2 03.12.2018 passed Cr.Misc. No. 66477 of 2018 and vide order dated 15.01.2019 passed in Cr.Misc. No. 1068 of 2019 and there was direction to the petitioner to renew his prayer for bail after framing of charge and now, charge has been framed and he is in custody for more than a year.

Having considered the aforesaid facts and circumstances, specially the fact that other co-accused persons having similar allegation have been granted bail by co-ordinate Bench of this Court, as such let this petitioner is directed to be released on bail upon furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Nawada Town P.S. Case No. 15 of 2018 with direction that he will co-operate in disposal of trial and will appear as and when required otherwise his bail bond shall be liable to be cancelled.
